End User Licence Agreement

This EULA grants the right to install and run the Wikai desktop app. Free use is personal and non-commercial; Supporter covers commercial use for one named person.

1. Agreement

This End User Licence Agreement is between you and Atomic Bits BV, Bruinbeekstraat 7, 2820 Bonheiden, Belgium, KBO/CBE 0837.568.373.

It applies when you install, launch, or use the Wikai desktop app. The Terms of Service, Privacy Policy, and Refund Policy also apply.

If this EULA and the Terms of Service conflict on the licence to install, run, copy, update, or restrict the desktop app, this EULA controls.

2. Licence grant

Subject to this EULA, Atomic Bits grants you a limited, non-exclusive, non-transferable, revocable licence to install and run Wikai.

There are three permitted licence situations:

  • Free personal use: you may use Wikai for personal, non-commercial purposes.
  • Commercial evaluation: you may use Wikai commercially for one 30-day evaluation period per organisation, only to decide whether to buy a Supporter licence.
  • Supporter use: while you hold an active Supporter licence, you may use Wikai commercially as one named person.

Wikai is licensed, not sold. You do not receive ownership of the software or source code.

3. Commercial use

Commercial use means using Wikai for purposes within your trade, business, craft, or profession, including use by or on behalf of an organisation of any kind.

Academic study and research is free for the individual doing the work, funded or not. An organisation deploying Wikai across a team or department is commercial use.

Everything outside your work is free.

4. Supporter named-user scope

A Supporter licence belongs to one person. That person may use Wikai on any number of their own devices.

You must not share a Supporter licence key, rotate it between people, use it for concurrent use by several people, or activate and deactivate it to pass the licence around a team.

An organisation must buy one Supporter licence for each person using Wikai commercially.

5. Commercial evaluation

Commercial evaluation is a permission, not a product tier. It unlocks no features, creates no account, and does not expire in code.

The evaluation permission lasts up to 30 consecutive days, starting on the first day you or your organisation use Wikai commercially. It is available once per organisation and only for genuine evaluation of whether to buy Supporter licences.

After the evaluation period, commercial use must stop or be covered by Supporter licences. You may keep using Wikai for permitted personal, non-commercial use.

Do not treat this evaluation permission as a free trial, refund window, warranty period, or statutory withdrawal right.

6. Restrictions

Except where applicable law expressly allows it, you must not:

  • copy, redistribute, rent, lease, sell, sublicense, commercially host, or make Wikai available as a service to others;
  • share, resell, forge, bypass, or interfere with licence keys or licence checks;
  • remove copyright, trademark, licence, or attribution notices;
  • modify, reverse engineer, decompile, or disassemble Wikai;
  • use Wikai to violate law or third-party rights;
  • use Wikai in a way that attacks, overloads, or interferes with Atomic Bits systems or third-party services.

The reverse-engineering restriction does not prevent anything that Belgian or EU law says cannot be restricted, including lawful acts needed to obtain interoperability with independently created software under the mandatory rules implementing Article 6 of Directive 2009/24/EC.

7. Your files and generated content

Your wiki files remain yours. Wikai stores them on your device as local files and does not send them to Atomic Bits.

You are responsible for deciding what material to ingest, what AI-generated edits to accept, and what output to rely on. You must keep appropriate backups or version history for important wiki folders.

AI-generated edits may be wrong, incomplete, or destructive. Wikai may edit, create, move, rename, or delete local files when you ask it or a connected agent to work in your wiki.

The chat sidebar uses the agent backend or API key you connect, such as Claude Code or an Anthropic API key. Internet search, when enabled, uses an external search provider such as Tavily or Brave.

Those services are not operated by Atomic Bits. Their terms, privacy notices, availability, pricing, limits, and outputs are their own.

9. Updates

Wikai may check for updates and receive updates. Updates may change, remove, or add functionality, fix bugs, patch security issues, or maintain compatibility with operating systems and signing requirements.

We will not intentionally remove the core local-first wiki functionality from a supported version without advance notice unless the change is needed for security, legal compliance, platform requirements, or urgent stability.

10. Open-source components

Wikai includes third-party open-source components. Those components remain licensed under their own licences. Where those licences require notices, source offers, or additional rights, those notices and rights apply.

This EULA does not limit rights you have directly under an open-source licence for a third-party component.

11. Termination

Your licence under this EULA ends if you materially breach it. Supporter commercial-use rights also end when your Supporter subscription expires, is cancelled, is refunded, or is terminated.

If Supporter rights end, you may continue using Wikai only for permitted personal, non-commercial use unless another valid commercial permission applies.

Your local wiki files remain on your device.

12. No telemetry expansion

Wikai’s local-first promise is part of the licence expectation. The app does not send Atomic Bits your wiki content, chat transcripts, product telemetry, page views, search queries, time-in-app, or usage analytics.

The app may contact Atomic Bits systems for narrow operational purposes such as update checks, licence validation for Supporter users, security notices, and delivery of services you request. The Privacy Policy describes the data involved.

13. Warranty disclaimer and liability

The disclaimers, liability limits, statutory-rights saver, governing law, and dispute terms in the Terms of Service apply to this EULA.

Nothing in this EULA limits rights that cannot be limited under applicable law, including mandatory consumer remedies for non-conforming digital content.
