These terms govern the Wikai website, Supporter subscriptions, support, and the service relationship with Atomic Bits BV. The desktop app licence itself is in the EULA.
1. Who these terms are with
These Terms of Service are between you and Atomic Bits BV, a Belgian company with KBO/CBE number 0837.568.373 and VAT number BE0837.568.373, Bruinbeekstraat 7, 2820 Bonheiden, Belgium.

Writing to the wrong one is not a problem — they reach the same place, and we will route it.
2. What these terms cover
These terms cover the Wikai website, Supporter subscriptions, customer support, licence keys, acceptable use, billing-related account handling, and our relationship with you as a Wikai customer or visitor.
The downloaded Wikai app is licensed under the End User Licence Agreement. If these terms and the EULA conflict on app-licence matters, the EULA controls. If they conflict on billing, support, website, or customer-service matters, these terms control.
Our Privacy Policy, Refund Policy, and EULA are part of the same legal surface.
3. Paddle is the merchant of record
Wikai orders are sold through Paddle.com, our online reseller and merchant of record. Paddle is the seller on the payment transaction. Paddle handles checkout, payment processing, tax calculation, receipts, payment methods, chargebacks, and the customer portal.
Atomic Bits supplies the Wikai software, support, licence keys, product information, and product remedies. Our terms are the supplier terms that govern your licence to use Wikai and your relationship with us.
Before checkout opens, you must accept these terms and the Refund Policy. Paddle’s own buyer terms also apply to the sale transaction.
4. Free use and Supporter use
Wikai has two practical modes:
- Free use: personal, non-commercial use of the app.
- Supporter use: a paid licence for commercial use, plus email support and a Supporter badge.
The feature set is intentionally local-first. Your wikis are Markdown files on your own disk. The free tier is not a feature-limited demo, and it is not a trial that converts to a paid subscription.
5. Commercial use
Commercial use means using Wikai for purposes within your trade, business, craft, or profession, including use by or on behalf of an organisation of any kind: business, charity, NGO, university, public body, or other institution.
Academic study and research is free for the individual doing the work, funded or not. A university, lab, company, or department deploying Wikai across a team is commercial use.
Everything outside your work is free: your own learning, your own projects, and anything you do on your own time.
6. Thirty-day commercial evaluation
If you or your organisation are evaluating Wikai for commercial use, we grant one temporary permission to use Wikai commercially for up to 30 consecutive days, starting on the first day of commercial use.
That permission is only for deciding whether to buy a Supporter licence. It does not renew, it does not apply separately to every person in the same organisation, and it is not a warranty period, refund window, or statutory withdrawal right.
After the evaluation period, commercial use must stop or be covered by a Supporter licence. The app will not technically stop working, and your wiki files are not locked or changed.
7. Supporter subscriptions
A Supporter licence is a named-user licence. It covers one person, on any number of that person’s own devices. It does not cover use by multiple people, team sharing, key sharing, rotating a licence between people, or concurrent use by several people.
A five-person organisation needs five Supporter licences for five people using Wikai commercially.
Subscriptions renew automatically until cancelled. You can cancel future renewals through the Paddle customer portal linked from your receipt. Unless the Refund Policy or mandatory law says otherwise, cancellation takes effect at the end of the period already paid for.
If a payment fails, we may retry collection through Paddle, contact you, or let the Supporter licence lapse. If it lapses, Wikai keeps working in the free tier for permitted personal, non-commercial use.
8. Refunds and statutory rights
Our refund commitments are in the Refund Policy.
Nothing in these terms limits consumer rights that cannot be excluded by law, including rights for faulty, non-conforming, or misdescribed digital content.
9. Your wiki content and ingested material
Your wiki content remains yours. Wikai stores your wikis as local Markdown files on your device. Atomic Bits does not receive, host, back up, index, or train on your wiki content.
You are responsible for the material you import, process, summarise, or quote with Wikai. You promise that your use of ingested material and your processing of it with Wikai will not violate law, copyright, confidentiality duties, privacy rights, publicity rights, or other third-party rights.
If you send us a support attachment, bug report, log excerpt, screenshot, or feedback, you give us permission to use it only for support, debugging, security, product improvement, and communicating with you. That permission does not apply to your whole wiki.
10. Local files, AI-generated edits, and backups
Wikai is local-first, which means there is no server copy for us to restore if something goes wrong on your machine.
The app and any connected AI agent may create, edit, rename, move, or delete local files when you ask them to work in your wiki. AI output may be wrong, incomplete, destructive, or unsuitable for your purpose. You are responsible for reviewing changes before relying on them and for keeping appropriate backups or version history of important wiki folders.
To the maximum extent allowed by law, Atomic Bits is not liable for loss or corruption of local files, loss of business information, loss of profits, or the cost of reconstructing data, except where liability cannot be excluded or limited by law.
11. Third-party services
Some Wikai features use third-party services only when you choose to use them:
- the chat sidebar uses the agent backend or API key you connect;
- internet search, when enabled, sends queries to Tavily or Brave;
- Paddle handles checkout, tax, billing, receipts, renewals, and the customer portal;
- Cloudflare, Resend, GitHub, Apple, and Microsoft support hosting, email, feedback, and signed builds as described in the Privacy Policy.
Those services are operated by their providers under their own terms. We are not responsible for their availability, pricing, rate limits, output, security practices, or decisions.
12. Acceptable use
You must not use Wikai, the website, support channels, licence keys, or related services to:
- break the law or violate another person’s rights;
- upload, process, or distribute material you are not allowed to use;
- share, resell, rent, sublicense, or commercially host Wikai licence keys or signed binaries;
- bypass licence checks or forge licence keys;
- interfere with the website, licence service, checkout flow, update service, or support systems;
- use Supporter support for someone who is not the named licence holder;
- abuse refund, chargeback, evaluation, or support processes.
13. Updates and changes to the app
Wikai may check for updates and may offer or install updates depending on your app settings and operating system. Updates may fix bugs, improve security, add features, remove features, or change behaviour.
We will not intentionally remove the core local-first wiki functionality from a supported version without advance notice, unless the change is needed for security, legal compliance, platform requirements, or urgent stability.
14. Intellectual property
Wikai is licensed, not sold. Atomic Bits and its licensors keep all rights in the Wikai software, website, brand, design, documentation, licence service, and related materials.
You may not remove copyright notices, trademarks, or licence notices from the app or documentation. Open-source components remain governed by their own licences. Where required, third-party notices and source-offer information will be supplied with the app or documentation.
15. Suspension and termination
We may suspend or terminate your Supporter licence, support access, or access to related services if you materially breach these terms or the EULA, share a licence key, abuse support, commit fraud, attack our systems, or start an abusive or fraudulent chargeback.
Where reasonable, we will give notice and a chance to fix the issue. For fraud, security issues, key sharing, chargeback abuse, or legal risk, we may act immediately.
If a Supporter licence ends, Wikai keeps working in the free tier for permitted personal, non-commercial use. Your local wiki files remain on your device.
Sections about ownership, your content, payment obligations, disclaimers, liability limits, governing law, and clauses that by nature should survive termination will survive.
16. Disclaimers
Wikai is provided with reasonable care, but it is not guaranteed to be error-free, uninterrupted, secure against every threat, or suitable for every purpose. AI-generated content may be inaccurate. Search results may be incomplete. Third-party services may fail or change.
Nothing in these terms excludes legal guarantees or remedies that apply to you as a consumer and cannot be excluded by law.
17. Liability
To the maximum extent allowed by law, Atomic Bits’ total liability under or relating to Wikai, these terms, the EULA, or a Supporter subscription is limited to the fees you paid for Wikai in the 12 months before the event giving rise to the claim.
For free users, that amount is zero unless mandatory law requires otherwise. Counsel is specifically asked to confirm whether a monetary floor should apply to free users.
Multiple claims do not increase the cap.
Nothing in these terms limits liability that cannot be limited under applicable law, including liability for death or personal injury, fraud, wilful misconduct, gross negligence, or mandatory consumer remedies.
18. Changes to these terms
If we make material changes to these terms, the EULA, Privacy Policy, or Refund Policy, we will note the date and give customers at least 30 days’ notice by email where we have an email address for them. If a change is required urgently for security, law, platform rules, or abuse prevention, we may apply it sooner.
If you do not accept a material change, you can stop using Wikai and cancel future renewals before the change takes effect. Mandatory consumer rights remain unaffected.
19. Governing law and courts
These terms are governed by Belgian law.
If you are a consumer, you keep the mandatory protections and forum rights given by the law of the country where you live. Otherwise, disputes are handled by the competent courts for Atomic Bits BV’s registered seat, currently the courts with jurisdiction over Bonheiden, Belgium.
